See how fast the judiciary has acted for actor Salman Khan after the verdict was pronounced….the fastest bail announcement. If not for Salman, the people have raised doubts if this fastness could have been shown. The whole Khan episode is nothing but what shows how power and money rules. The common man still has to walk down the corridors of powers for justice, but for nothing.

The country also saw hundreds performing havan, poojaas and even coming out in the street for Khan who was sentenced for five years by the local court in a hit and run case. But who was there for the one who died and those who were injured. And no one ever remembered policeman Ravindra Patil, who was the prime witness in the case. Patil died suffering from a strain of TB, but no one was there to help him. Even his family members had deserted him and his body was also never claimed by his relatives.

The court’s decision was widely criticised and many of the people have expressed their displeasure at the decision in the social media. After a few criticism and displeasure, Khan Episode has drifted away just like all the many issues that have always found a grave.

When everyone has equal rights and should be considered equal, why then in India some are more equal. It is not that this is the first instance that the system is considering some as more equals… this has been going on for decades and will go on for decades to come…politics, money, power… the three words that has created more equals among us…    

Attakulangara School: HC stays all proceedings

The High Court has stayed all further proceedings, including the demolition of the boundary walls and other structures of the Attakulangara School, which is in the eye of a storm over the Trivandrum Development Authority's (TRIDA) plan to take over the land and build a bus bay and shopping complexes.

A bench comprising acting Chief Justice Ashok Bhushan and Justice A M Shaffique stayed the demolition, observing that there was total prohibition on the assignment of school property other than educational purposes.

The court pronounced the order on a petition filed by Tree Walk, a group of citizens who are for protecting the green cover of Thiruvananthapuram city.

In the petition, it has been stated that the proposal for the establishment of bus terminal and shopping complex by TRIDA will adversely affect the rich biodiversity maintained by the school and it was illegal. The petitioner had also contended that no environment impact assessment was conducted before undertaking the project. ''There are about 32 species of trees numbering about 100 in this compound. In addition there are herbal plants. The experts have already found that there are about 30 species of birds, 25 species of butterflies and more than 10 species of dragonflies in the school compound. This land in the heart of the city is the Green lung of the Trivandrum City and the last patch of greenery in the city,'' the petition said.

Kerala State to move SC against Stay order in HML case

The state government is likely to move the Supreme Court against the Stay  granted by the High Court on the criminal proceedings initiated against officials of Harrisons Malayalam Ltd (HML) in a case relating to forgery of documents and survey maps. The Supreme Court is being approached, alleging that the stay was granted illegally against the statute of the apex court.

The High Court had recently extended the stay even when the case was reserved for passing judgment. Highly placed officials in the Revenue department said that all these would only lead to a slow down of the government's initiative in retrieving the lands in the illegal possession of the HML and others.

A high level meeting held recently, represented by the Vigilance director, Home secretary, revenue Secretary, law secretary, Special government pleader (revenue) and other officials had concluded that the stay was illegal and there was an urgency to move the SC in this regard. 

The government is of the opinion that the Statutory powers under section 19 (3) (c) has been overlooked while granting the stay. As per this section, no court shall stay the proceedings under this act on any other ground  and the court shall exercise the powers of revision in relation to any interlocutory order passed in any inquiry, trial, appeal or other proceedings.

Defying Court orders, KDH given licence for Home stays in Munnar , Kerala

Defying Kerala High Court's direction and contrary to Kerala government's objections, as many as 20 bungalows of the Kanan Devan Hills Plantations Company Private Limited in Munnar have been given license for running Homestays. The Revenue and district administration have been kept in the dark while issuing license by the Munnar and Devikulam panchayats.

The panchayat authorities have also given NOC to M/s Muthoot Hotels Pvt Ltd to run tourist bungalows on the basis of the license already issued in the name of KDHP company.

In an interim order dated December 7, 2012 The High Court has said that its concurrence and direction was needed for any decision related to giving license for Homestays or use of the land for tourism purposes. The Court had also directed that the order of the LSGD Ombudsman giving permission to grant licenses should not be implemented. However, the Munnar and Devikulam Panchayat secretaries have issued licenses on the basis of the Ombudsman's order.

Devikulam RDO Madhu Gangadhar said that the NOC and the license has been issued without consulting the district administration or the revenue department.
Legal experts point out that the action of both the panchayat secretaries amount to contempt of court. There are allegations that certain political leaders leaders were behind issuing the license.

Sufiya Madhani arrested

Sufiya Madhani, wife of PDP leader Abdul Nazar Madhani, was arrested after the Kerala High Court denied her anticipatory bail in the Kalamassery bus burning case.

The Kerala High Court rejected the bail on the grounds that custodial interrogation was necessary in the case.
